HOTARĀRE Nr. 1218 din 6 septembrie 2006 privind stabilirea cerintelor minime de securitate si sanatate īn munca pentru asigurarea protectiei lucratorilor īmpotriva riscurilor legate de prezenta agentilor chimici

Īn temeiul art. 108 din Constitutia Romāniei, republicata, si al art. 51 alin. (1) lit. b) din Legea securitatii si sanatatii īn munca nr. 319/2006,

Guvernul Romāniei adopta prezenta hotarāre.

CAP. 1
Dispozitii generale

SECTIUNEA 1
Obiectul de reglementare si domeniul de aplicare

ART. 1
Prezenta hotarāre stabileste cerintele minime pentru protectia lucratorilor īmpotriva riscurilor pentru securitatea si sanatatea lor, care provin sau pot proveni din efectele agentilor chimici prezenti la locul de munca ori ca rezultat al oricarei activitati profesionale care implica agenti chimici.
ART. 2
Legea securitatii si sanatatii īn munca nr. 319/2006 se aplica īn totalitate īntregului domeniu prevazut la art. 1.
ART. 3
Īn cazul prezentei substantelor cancerigene si mutagene la locul de munca, prevederile prezentei hotarāri se aplica cu respectarea prevederilor Hotarārii Guvernului nr. 1.093/2006 privind stabilirea cerintelor minime de securitate si sanatate pentru protectia lucratorilor īmpotriva riscurilor legate de expunerea la agenti cancerigeni sau mutageni la locul de munca.
ART. 4
(1) Cerintele minime de securitate si sanatate īn munca prevazute de prezenta hotarāre se aplica īn cazul īn care agentii chimici periculosi sunt prezenti sau pot fi prezenti la locul de munca, cu respectarea prevederilor privind masurile de protectie īmpotriva radiatiilor ionizante aplicabile agentilor chimici, conform legislatiei nationale elaborate de Comisia Nationala pentru Controlul Activitatilor Nucleare, īn temeiul Legii nr. 111/1996 privind desfasurarea īn siguranta, reglementarea, autorizarea si controlul activitatilor nucleare, republicata, si armonizate cu directivele adoptate īn conformitate cu Tratatul de instituire a Comunitatii Europene a Energiei Atomice.
(2) La transportul agentilor chimici periculosi, prevederile prezentei hotarāri se aplica cu respectarea dispozitiilor mai favorabile protectiei sanatatii si securitatii lucratorilor īn munca din legislatia nationala armonizata cu:
a) Directiva 96/49/CE privind apropierea legislatiilor statelor membre referitoare la transportul feroviar de marfuri periculoase, publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 235/1996; din Ordonanta Guvernului nr. 49/1999 privind transportul marfurilor periculoase pe calea ferata, aprobata cu modificari prin Legea nr. 788/2001; Hotarārea Guvernului nr. 323/2000 privind stabilirea componentei, atributiilor si regulamentului de organizare si functionare ale Comitetului interministerial pentru transportul marfurilor periculoase pe calea ferata; Ordinul ministrului lucrarilor publice, transporturilor si locuintei nr. 891/2003 pentru stabilirea unor reguli privind transportul marfurilor periculoase pe calea ferata; Ordinul ministrului transporturilor, constructiilor si turismului nr. 2.224/2004 pentru stabilirea unor reguli privind transportul marfurilor periculoase pe calea ferata; Ordonanta Guvernului nr. 7/2005 pentru aprobarea Regulamentului privind transportul pe caile ferate din Romānia, aprobata cu modificari si completari prin Legea nr. 110/2006; si Ordinul ministrului transporturilor, constructiilor si turismului nr. 644/2005 pentru stabilirea unor reguli privind transportul marfurilor periculoase pe calea ferata;
b) Directiva 2002/59 privind crearea unui sistem comunitar de urmarire si de informarea traficului navelor si de abrogare a Directivei Consiliului 93/75/CEE, publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 208/2002; din Ordinul ministrului transporturilor, constructiilor si turismului nr. 389/2006 pentru aprobarea sistemului de inspectii obligatorii la navele de tip feribot Ro-Ro, precum si la navele de pasageri de mare viteza care opereaza īn serviciu regulat;
c) Directiva 94/55/CE privind apropierea legislatiilor statelor membre referitoare la transportul rutier al marfurilor periculoase, publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 319/1994; din Ordonanta de urgenta a Guvernului nr. 109/2005 privind transporturile rutiere, aprobata cu modificari si completari prin Legea nr. 102/2006; Ordonanta Guvernului nr. 48/1999 privind transportul rutier al marfurilor periculoase, aprobata cu modificari prin Legea nr. 122/2002 si prin Hotarārea Guvernului nr. 1.374/2000 pentru aprobarea Normelor privind aplicarea etapizata īn traficul intern a prevederilor Acordului european referitor la transportul rutier international al marfurilor periculoase (A.D.R.), īncheiat la Geneva la 30 septembrie 1957, la care Romānia a aderat prin Legea nr. 31/1994, cu modificarile si completarile ulterioare;
d) codul IMDG - codul maritim international al marfurilor periculoase īn vigoare, Codul IBC - lista internationala a Organizatiei Maritime Internationale, denumita īn continuare OMI, cu reglementarile referitoare la constructia si echipamentul navelor care transporta produse chimice periculoase īn vrac si Codul IGC - lista internationala a OMI, cu reglementarile referitoare la constructia si echipamentul navelor care transporta gaze lichefiate īn vrac;
e) Acordul european privind transportul international al marfurilor periculoase pe caile navigabile interioare si Regulamentul privind transportul intern al substantelor periculoase pe Rin, astfel cum sunt incluse īn dreptul comunitar;
f) instructiunile tehnice pentru transportul marfurilor periculoase īn conditii de siguranta, emise de Organizatia Internationala a Aviatiei Civile.

SECTIUNEA a 2-a
Definitii

ART. 5
Īn īntelesul prezentei hotarāri, termenii si expresiile de mai jos au urmatoarele semnificatii:
1. agent chimic - orice element sau compus chimic, singur ori īn amestec, īn stare naturala sau fabricat, utilizat ori eliberat, inclusiv sub forma de deseuri, prin orice activitate profesionala, fie ca este produs intentionat sau nu, fie ca este introdus pe piata ori nu;
2. agent chimic periculos:
a) orice agent chimic care īntruneste criteriile de clasificare ca substanta periculoasa īn conformitate cu anexa nr. 1 la Normele metodologice de aplicare a Ordonantei de urgenta a Guvernului nr. 200/2000 privind clasificarea, etichetarea si ambalarea substantelor si preparatelor chimice periculoase, aprobate prin Hotarārea Guvernului nr. 490/2002, cu modificarile si completarile ulterioare, fie ca acea substanta este clasificata īn temeiul hotarārii mentionate sau nu, cu exceptia substantelor care īntrunesc numai criteriile de clasificare ca substante periculoase pentru mediu;
b) orice agent chimic care īntruneste criteriile de clasificare ca preparat periculos īn sensul Normelor metodologice privind clasificarea, etichetarea si ambalarea preparatelor chimice periculoase, aprobate prin Hotarārea Guvernului nr. 92/2003, fie ca acel preparat este clasificat īn temeiul hotarārii mentionate sau nu, cu exceptia acelor preparate care īntrunesc numai criteriile de clasificare ca preparate periculoase pentru mediu;
c) orice agent chimic care, desi nu īntruneste criteriile de clasificare ca fiind periculos īn conformitate cu prevederile mentionate la lit. a) si b), poate prezenta un risc pentru securitatea si sanatatea lucratorilor datorita proprietatilor sale fizico-chimice, chimice sau toxicologice si a modului īn care este utilizat sau este prezent la locul de munca, inclusiv orice agent chimic caruia i s-a atribuit o valoare limita de expunere profesionala potrivit prevederilor art. 6 - 10;
3. activitate care implica agenti chimici - orice proces de munca īn care sunt utilizati sau se intentioneaza sa se utilizeze agenti chimici, īn orice proces, inclusiv producerea, manipularea, depozitarea, transportul ori eliminarea si tratarea, sau orice asemenea proces de munca din care rezulta agenti chimici;
4. valoare limita de expunere profesionala - daca nu se specifica altfel, limita mediei ponderate īn functie de timp a concentratiei unui agent chimic īn aerul zonei īn care respira un lucrator, pentru o perioada de referinta specificata, pentru 8 ore sau pentru un termen scurt de maximum 15 minute;
5. valoare limita biologica - limita concentratiei, īn mediul sau biologic de referinta, a unui agent chimic relevant, a metabolitului sau ori a unui indicator al efectului;
6. supraveghere a sanatatii - evaluarea medicala a unui lucrator pentru a se determina starea sanatatii acelui individ, īn relatie cu expunerea la agenti chimici specifici īn munca;
7. pericol - proprietatea intrinseca, cu potential de a dauna, a unui agent chimic;
8. risc - probabilitatea ca potentialul de a dauna sa produca efecte īn conditiile utilizarii si/sau expunerii.
ART. 6
Ministerul Muncii, Solidaritatii Sociale si Familiei informeaza organizatiile lucratorilor si ale angajatorilor cu privire la valorile limita de referinta privind expunerea profesionala, care sunt stabilite la nivelul Comisiei Europene.

SECTIUNEA a 3-a
Valori limita de expunere profesionala si valori limita biologice

ART. 7
(1) Pentru orice agent chimic pentru care este stabilita la nivelul Uniunii Europene o valoare limita de referinta privind expunerea profesionala, se stabileste o valoare limita obligatorie nationala de expunere profesionala, tinānd cont de valoarea limita existenta la nivel comunitar.
(2) Pentru orice agent chimic pentru care este stabilita la nivel comunitar o valoare limita obligatorie de expunere profesionala, se stabileste o valoare limita obligatorie nationala de expunere profesionala corespondenta, tinānd cont, īn acest sens, de valoarea limita comunitara, fara a o depasi.
(3) Valorile limita obligatorii nationale de expunere profesionala ale agentilor chimici, prevazute la alin. (1) si (2), reflecta factorii de utilitate pentru a asigura sanatatea lucratorilor la locul de munca si sunt prevazute īn anexa nr. 1. Aceste valori limita se stabilesc potrivit art. 44 si, īmpreuna cu datele stiintifice si tehnice relevante, sunt comunicate Ministerului Muncii, Solidaritatii Sociale si Familiei.
ART. 8
(1) Pentru orice agent chimic pentru care se stabileste o valoare limita biologica obligatorie la nivel comunitar, se stabileste o valoare limita biologica obligatorie nationala, bazata pe valoarea limita a Uniunii Europene, fara sa o depaseasca.
(2) Valorile limita biologice obligatorii nationale, prevazute la alin. (1), se stabilesc pe baza unei evaluari stiintifice si a tehnicilor de masurare disponibile, reflecta factorii de utilitate pentru a asigura sanatatea lucratorilor la locul de munca si sunt prevazute īn anexa nr. 2. Aceste valori limita se stabilesc potrivit art. 44 si, īmpreuna cu datele stiintifice si tehnice relevante, sunt comunicate Ministerului Muncii, Solidaritatii Sociale si Familiei.
ART. 9
Īn cazul īn care sunt revizuite sau introduse, dupa caz, valorile limita nationale pentru un agent chimic prevazute la art. 7 si 8, Ministerul Muncii, Solidaritatii Sociale si Familiei informeaza Comisia Europeana si statele membre despre acest lucru si despre datele stiintifice si tehnice relevante.
ART. 10
Metode standardizate de masurare si evaluare a concentratiilor din aer la locul de munca īn legatura cu valorile limita de expunere profesionala se stabilesc īn conformitate cu recomandarile practice elaborate de Comisia Europeana.

CAP. 2
Obligatiile angajatorilor

SECTIUNEA 1
Determinarea si evaluarea riscului implicat de agentii chimici periculosi

ART. 11
(1) Īn īndeplinirea obligatiei sale de a asigura sanatatea si securitatea lucratorilor īn cadrul oricarei activitati care implica agenti chimici periculosi, angajatorul ia masurile preventive necesare, prevazute la art. 7 alin. (1) - (3) din Legea nr. 319/2006, si include masurile prevazute īn prezenta hotarāre.
(2) Angajatorul trebuie sa se asigure ca riscul pentru securitatea si sanatatea lucratorilor īn procesul de munca, indus de un agent chimic periculos, este eliminat sau redus la minimum. Este obligatorie respectarea valorilor limita de expunere profesionala la agenti chimici īn mediul de munca, prevazute īn anexa nr. 1, si valorile limita biologice tolerabile de lucratori, prevazute īn anexa nr. 2, cu mentinerea concentratiilor agentilor chimici la cel mai scazut nivel posibil.
(3) Valorile limita prevazute la alin. (1) reprezinta valori maxime admise.
ART. 12
(1) Angajatorul, īn īndeplinirea obligatiilor stabilite īn art. 7 alin. (4) si īn art. 12 alin. (1) din Legea nr. 319/2006, trebuie sa determine existenta oricarui agent chimic periculos la locul de munca.
(2) Īn cazul īn care se constata prezenta agentilor economici periculosi la locul de munca, angajatorul trebuie sa evalueze orice risc referitor la securitatea si sanatatea lucratorilor, care decurge din prezenta acestor agenti chimici, luānd īn considerare:
a) proprietatile lor periculoase;
b) informatiile puse la dispozitie de furnizor referitoare la securitatea si sanatatea lucratorilor, cum ar fi fisele tehnice de securitate, īn conformitate cu prevederile Hotarārii Guvernului nr. 490/2002, cu modificarile si completarile ulterioare;
c) nivelul, tipul si durata expunerii;
d) conditiile īn care se desfasoara lucrul īn prezenta unor astfel de agenti, inclusiv cantitatile acestora;
e) valorile limita de expunere profesionala sau valorile limita biologice nationale;
f) efectul masurilor preventive luate sau care urmeaza sa fie luate;
g) concluziile care rezulta īn urma supravegherii starii de sanatate deja efectuate, atunci cānd sunt disponibile.
(3) Angajatorul trebuie sa obtina informatii suplimentare necesare pentru evaluarea riscului de la furnizorul agentilor chimici periculosi sau din alte surse disponibile. Daca este cazul, aceste informatii trebuie sa contina evaluarea specifica privind riscul pentru utilizatori, stabilit pe baza prevederilor legislatiei nationale aplicabile, armonizata cu legislatia comunitara cu privire la agentii chimici.
ART. 13
Angajatorul trebuie sa se afle īn posesia unei evaluari a riscului, īn conformitate cu art. 12 din Legea nr. 319/2006, si sa identifice ce masuri trebuie luate potrivit art. 12 - 24.
ART. 14
(1) Evaluarea riscului trebuie īnsotita de documente prezentate īntr-o forma adecvata, īn conformitate cu legislatia si practica nationala, si poate include o justificare a angajatorului referitoare la faptul ca natura si amploarea riscurilor datorate agentilor chimici nu necesita o alta evaluare detaliata a riscului.
(2) Evaluarea riscului se actualizeaza, īn special, daca s-au produs schimbari semnificative din cauza carora evaluarea ar fi depasita sau atunci cānd rezultatele supravegherii starii de sanatate fac necesar acest lucru.
(3) Īn evaluarea riscului trebuie incluse si anumite activitati īn cadrul īntreprinderii sau al unitatii, cum ar fi īntretinerea, īn timpul carora este previzibila aparitia unui risc de expunere semnificativ sau care, din alte cauze, pot avea efecte vatamatoare pentru securitate si sanatate, chiar dupa ce au fost luate toate masurile tehnice.
(4) Īn cazul activitatilor care implica expunerea la mai multi agenti chimici periculosi, riscul trebuie evaluat pe baza riscului prezentat de toti acesti agenti chimici īn combinatie.
ART. 15
Īn cazul unei activitati noi care implica agenti chimici periculosi, procesul de munca trebuie sa īnceapa numai dupa ce a fost realizata o evaluare a riscului acelei activitati si dupa luarea masurilor de prevenire identificate ca necesare.
ART. 16
Ghidurile practice care detaliaza prevederile referitoare la evaluarea riscurilor si la aplicarea masurilor de prevenire pentru diminuarea acestora vor fi elaborate īn conformitate cu recomandarile practice ale Comisiei Europene.

SECTIUNEA a 2-a
Principii generale pentru prevenirea riscurilor asociate cu agentii chimici periculosi si pentru aplicarea prezentei hotarāri potrivit evaluarii de risc

ART. 17
Angajatorul este obligat sa ia masuri de eliminare sau de reducere la minimum a riscurilor pentru securitatea si sanatatea lucratorilor īn procesele de munca īn care sunt implicati agenti chimici periculosi, īn special prin:
a) proiectarea si organizarea sistemelor de lucru la locul de munca;
b) dotarea cu echipament corespunzator pentru lucrul cu agentii chimici, elaborarea si implementarea procedurilor de īntretinere, care sa asigure securitatea si sanatatea lucratorilor īn procesul de munca;
c) reducerea la minimum a numarului de lucratori expusi sau care pot fi expusi;
d) reducerea la minimum a duratei si intensitatii de expunere;
e) masuri corespunzatoare de igiena;
f) reducerea cantitatii de agenti chimici prezenti la locul de munca la nivelul minim necesar pentru tipul de activitate respectiva;
g) proceduri adecvate de lucru care includ īn special reglementari tehnice privind manipularea, depozitarea si transportul īn conditii de siguranta la locul de munca ale agentilor chimici periculosi si ale deseurilor care contin asemenea agenti chimici.
ART. 18
(1) Daca rezultatele evaluarii riscurilor prevazute la art. 12 indica prezenta unui risc pentru securitatea si sanatatea lucratorilor, se aplica masurile specifice de protectie, prevenire si supraveghere prevazute la art. 19 - 29 si la art. 38 - 42 din prezenta hotarāre.
(2) Daca rezultatele evaluarii riscurilor, conform art. 12, arata ca datorita cantitatii de agent chimic periculos prezent la locul de munca exista doar un risc redus pentru securitatea si sanatatea lucratorilor, iar masurile luate īn conformitate cu art. 11 alin. (1), art. 17 si art. 20 alin. (4) sunt suficiente pentru a diminua acel risc, atunci prevederile art. 19 - 29 si 38 - 42 nu se aplica.

SECTIUNEA a 3-a
Masuri specifice de protectie si prevenire

ART. 19
Angajatorul va asigura ca riscul pentru securitatea si sanatatea lucratorilor cauzat de prezenta la locul de munca a unui agent chimic periculos este eliminat sau redus la minimum.
ART. 20
(1) Īn aplicarea art. 9 se recurge de preferinta la substituire, prin care angajatorul evita utilizarea unui agent chimic periculos, īnlocuindu-l cu un agent sau proces chimic care, īn conditiile utilizarii, nu este periculos sau este mai putin periculos pentru securitatea si sanatatea lucratorilor, dupa caz.
(2) Atunci cānd tipul activitatii nu permite eliminarea riscului prin substituire, tinānd cont de activitatea si evaluarea riscului prevazute la art. 12 - 16, angajatorul asigura reducerea la minimum a riscului prin aplicarea masurilor de protectie si prevenire.
(3) Īn ordinea prioritatii, masurile prevazute la alin. (2) includ:
a) proiectarea unor procese de munca si control tehnic adecvate si utilizarea echipamentelor si materialelor potrivite, astfel īncāt sa se evite sau sa se reduca la minimum emiterea de agenti chimici periculosi care pot prezenta un risc pentru siguranta si sanatatea lucratorilor la locul de munca;
b) aplicarea unor masuri de protectie colectiva la sursa riscului, cum ar fi ventilatia adecvata si masurile potrivite de organizare;
c) aplicarea unor masuri de protectie individuala, inclusiv asigurarea echipamentului individual de protectie, daca expunerea nu poate fi prevenita prin alte mijloace.
(4) Ghidurile practice pentru aplicarea masurilor de protectie si prevenire īn vederea reducerii riscului sunt elaborate potrivit art. 43.
ART. 21
Masurile prevazute la art. 20 sunt completate cu cele de supraveghere a starii de sanatate, conform art. 38 - 42, daca natura riscului o cere.
ART. 22
Daca nu demonstreaza clar prin alte mijloace de evaluare ca, īn conformitate cu art. 20, au fost luate masuri adecvate de prevenire si protectie, angajatorul efectueaza masurarile necesare ale agentilor chimici care pot prezenta un risc pentru sanatatea lucratorului la locul de munca, īn mod regulat si ori de cāte ori se produce vreo schimbare a conditiilor care pot afecta expunerea lucratorilor la agenti chimici, īn special cu privire la valorile limita de expunere profesionala.
ART. 23
(1) Īn īndeplinirea obligatiilor prevazute la art. 12 - 16 sau care decurg, pe cale de consecinta, din acestea, angajatorul tine seama de rezultatele procedurilor prevazute la art. 22.
(2) Īn situatia īn care o valoare limita de expunere profesionala stabilita efectiv la nivel national a fost depasita, angajatorul ia masuri imediat, tinānd cont de natura acelei limite, pentru a remedia situatia prin aplicarea masurilor preventive si de protectie.
ART. 24
(1) Pe baza evaluarii globale si a principiilor generale pentru prevenirea riscurilor prevazute la art. 11 alin. (1), art. 12 - 18 si la art. 20 alin. (4) angajatorul ia masuri tehnice si/sau organizatorice potrivite cu natura operatiunii, inclusiv depozitarea, manipularea si separarea agentilor chimici incompatibili, asigurānd protectia lucratorilor īmpotriva riscurilor care decurg din proprietatile fizico-chimice ale agentilor chimici.
(2) Informatiile prevazute la alin. (1) sunt luate, īn ordinea prioritatii, īn special, pentru:
a) a preveni prezenta la locul de munca a concentratiilor periculoase ale substantelor inflamabile sau a cantitatilor periculoase de substante chimice instabile, īn cazul īn care natura muncii permite acest lucru;
b) a evita prezenta surselor de aprindere care pot da nastere unor incendii si explozii sau a conditiilor nefavorabile care pot determina ca substantele chimice instabile ori amestecurile de substante sa genereze efecte fizice daunatoare; si
c) a diminua efectele negative pentru sanatatea si securitatea lucratorilor īn caz de incendiu sau explozie, din cauza aprinderii substantelor inflamabile, ori efectele fizice daunatoare care decurg din prezenta substantelor chimice instabile sau a amestecurilor de substante.
(3) Echipamentul de lucru si sistemele protectoare asigurate de angajator pentru protectia lucratorilor trebuie sa fie conforme cu prevederile legislatiei aplicabile cu privire la proiectare, productie si livrare, avāndu-se īn vedere asigurarea sanatatii si securitatii.
(4) Masurile tehnice si/sau organizatorice luate de angajator trebuie sa ia īn considerare si sa fie conforme cu clasificarea grupelor de echipamente īn categorii prevazuta īn anexa nr. I la Hotarārea Guvernului nr. 752/2004 privind stabilirea conditiilor pentru introducerea pe piata a echipamentelor si sistemelor protectoare destinate utilizarii īn atmosfere potential explozive, cu modificarile ulterioare.
(5) Angajatorul ia masuri pentru a asigura un control adecvat al instalatiilor, echipamentelor si masinilor sau pentru a pune la dispozitie echipamentul de eliminare a exploziilor ori de reducere a presiunii care ar putea genera o explozie.

SECTIUNEA a 4-a
Masuri aplicabile īn cazul producerii de accidente, incidente sau urgente

ART. 25
Īn vederea protejarii securitatii si sanatatii lucratorilor īmpotriva accidentelor, incidentelor si urgentelor legate de prezenta unor agenti chimici periculosi la locul de munca, cu respectarea obligatiilor prevazute la art. 10 si 11 din Legea nr. 319/2006, angajatorul stabileste masuri sau planuri de actiune care pot fi aplicate atunci cānd se produce un asemenea eveniment, astfel īncāt sa fie luate masurile adecvate. Aceste masuri sau planuri de actiune trebuie sa includa orice exercitii de protectie adecvate, care vor fi efectuate la intervale regulate, precum si asigurarea mijloacelor adecvate de prim ajutor.
ART. 26
(1) Īn cazul īn care are loc unul dintre evenimentele prevazute la art. 25, angajatorul ia imediat masuri pentru a reduce efectele evenimentului si a informa lucratorii interesati.
(2) Pentru a readuce situatia la normal, angajatorul trebuie:
a) sa aplice masurile necesare pentru remedierea situatiei cāt mai rapid posibil;
b) sa permita sa lucreze īn zona afectata numai lucratorilor care sunt indispensabili pentru efectuarea reparatiilor si a altor operatiuni necesare.
ART. 27
(1) Lucratorilor carora li se permite sa lucreze īn zona afectata li se asigura īmbracaminte de protectie potrivita, echipament individual de protectie, echipament special de securitate si instalatiile pe care trebuie sa le utilizeze, atāt timp cāt situatia se mentine.
(2) Situatia prevazuta la art. 25 nu trebuie sa devina permanenta.
(3) Persoanelor neprotejate nu li se permite sa ramāna īn zona afectata.
ART. 28
Cu respectarea prevederilor art. 10 si 11 din Legea nr. 319/2006, angajatorul ia masurile necesare pentru a asigura sistemul de avertizare si alte sisteme de comunicare necesare pentru a semnala existenta unui risc crescut pentru securitate si sanatate, pentru a permite o reactie adecvata si pentru a īntreprinde imediat actiuni de remediere, precum si operatiuni de asistenta, evacuare si salvare, daca este nevoie.
ART. 29
(1) Angajatorul asigura disponibilitatea informatiilor cu privire la masurile aplicabile īn caz de urgenta, care implica agenti chimici periculosi.
(2) Serviciile interne si externe competente īn caz de accident si urgenta au acces la informatiile prevazute la alin. (1).
(3) Informatiile prevazute la alin. (1) includ:
a) notificarea prealabila a pericolelor legate de activitatea profesionala;
b) masurile de identificare a pericolelor;
c) masurile de precautie si procedurile pertinente, astfel īncāt serviciile de urgenta sa īsi poata pregati propriile proceduri de interventie si masuri de precautie; si
d) toate informatiile disponibile cu privire la pericolele concrete care apar sau pot aparea atunci cānd se produce un accident ori o situatie de urgenta;
e) informatii despre masurile de aplicare a acestui articol.

SECTIUNEA a 5-a
Informarea si instruirea lucratorilor

ART. 30
(1) Cu respectarea prevederilor art. 18, 22 si 23 din Legea nr. 319/2006, angajatorul se asigura ca lucratorilor sau reprezentantilor acestora li se furnizeaza:
a) datele obtinute īn baza prevederilor art. 12 - 16 si informatii suplimentare ori de cāte ori schimbari majore la locul de munca determina o modificare a acestor date;
b) informatii despre agentii chimici periculosi prezenti la locul de munca, cum ar fi denumirea acestor agenti, riscurile pentru securitate si sanatate, valorile limita de expunere profesionala, si prevederi legale;
c) instruire si informare privind precautiile necesare si actiunile ce trebuie īntreprinse pentru a se proteja pe ei īnsisi si pe alti lucratori la locul de munca;
d) acces la orice fisa tehnica de securitate, asigurat de catre furnizor īn conformitate cu cap. VIII din Normele metodologice privind clasificarea, etichetarea si ambalarea preparatelor chimice periculoase, aprobate prin Hotarārea Guvernului nr. 92/2003.
(2) Angajatorul se asigura ca informatia transmisa lucratorilor sau reprezentantilor acestora este:
a) furnizata īntr-un mod potrivit cu rezultatul evaluarii de risc prevazute la art. 12 - 16. Acesta poate merge de la comunicare orala pāna la instruirea si pregatirea individuala sustinute cu informatii scrise, īn functie de natura si gradul de risc indicate de evaluarea ceruta de dispozitiile alin. (1);
b) actualizata astfel īncāt sa tina cont de modificarea conditiilor.
ART. 31
Īn cazul īn care containerele si conductele pentru agenti chimici periculosi folositi la locul de munca nu sunt marcate īn conformitate cu legislatia nationala privind etichetarea substantelor si preparatelor chimice periculoase si semnalizarea de securitate la locul de munca lipseste sau este necorespunzatoare, angajatorul, cu respectarea derogarilor prevazute īn legislatia mentionata, ia masuri astfel īncāt continutul containerelor si conductelor, precum si natura acestui continut sa poata fi identificate clar.
ART. 32
Angajatorii pot obtine, la cerere, de la producator, furnizor sau de la oricare alta persoana care detine legal, toate informatiile despre agentii chimici periculosi, necesare pentru aplicarea art. 12, īn masura īn care Ordonanta de urgenta a Guvernului nr. 200/2000 privind clasificarea, etichetarea si ambalarea substantelor si preparatelor chimice periculoase, aprobata cu modificari si completari prin Legea nr. 451/2001, cu modificarile si completarile ulterioare, si Legea nr. 360/2003 privind regimul substantelor si preparatelor chimice periculoase, cu modificarile si completarile ulterioare, nu prevad obligatia de a asigura informatii.
ART. 33
Consultarea si participarea lucratorilor si/sau a reprezentantilor acestora privind problemele reglementate de prezenta hotarāre au loc potrivit art. 18 - 20 din Legea nr. 319/2006.

CAP. 3
Interdictii. Supravegherea starii de sanatate

SECTIUNEA I
Interdictii

ART. 34
Este interzisa producerea, fabricarea sau utilizarea la locul de munca a agentilor chimici prevazuti īn anexa nr. 3, īn conditiile prevazute īn aceasta anexa pentru a preveni expunerea lucratorilor la riscurile pentru sanatate pe care le pot prezenta anumiti agenti chimici si/sau anumite activitati care implica agenti chimici.
ART. 35
(1) Se pot permite exceptari de la cerintele art. 34 īn urmatoarele situatii:
a) pentru scopul exclusiv al cercetarii stiintifice si testarii, inclusiv al analizarii;
b) pentru activitatile menite sa elimine agentii chimici care sunt prezenti sub forma de produse secundare sau deseuri;
c) pentru producerea agentilor chimici prevazuti la art. 34 pentru a fi folositi ca produse intermediare si pentru utilizarea lor īn acest mod.
(2) Expunerea lucratorilor la agentii chimici prevazuti īn art. 34 trebuie sa fie prevenita, īn special prin masuri care prevad ca producerea si cea mai rapida utilizare a acestor agenti chimici ca produse intermediare trebuie sa aiba loc īntr-un sistem īnchis unic, din care agentii chimici respectivi pot fi scosi numai īn masura īn care acest lucru este necesar pentru monitorizarea procesului sau īntretinerea sistemului.
ART. 36
Cānd se permit derogari īn temeiul art. 34, Ministerul Muncii, Solidaritatii Sociale si Familiei cere angajatorului sa prezinte urmatoarele date:
a) motivul pentru care se solicita derogarea;
b) cantitatea de agent chimic ce va fi folosita anual;
c) activitatile si/sau reactiile sau procesele implicate;
d) numarul lucratorilor care pot fi implicati;
e) masurile de persecutie prevazute pentru a se proteja securitatea si sanatatea lucratorilor implicati;
f) masurile tehnice si organizatorice luate pentru a preveni expunerea lucratorilor.
ART. 37
Ministerul Muncii, Solidaritatii Sociale si Familiei īmpreuna cu Ministerul Sanatatii Publice pot fi initiatori ai hotarārii care urmeaza sa modifice lista interdictiilor prevazute la art. 34, pentru a include si alti agenti chimici sau alte activitati, pe baza modificarilor aduse listei de interdictii stabilite de Consiliul Uniunii Europene.

SECTIUNEA a 2-a
Supravegherea starii de sanatate

ART. 38
(1) Cu respectarea prevederilor art. 26 si 27 din Legea nr. 319/2006, Ministerul Sanatatii Publice introduce masurile necesare pentru realizarea supravegherii adecvate a starii de sanatate a lucrarilor pentru care rezultatele evaluarii, prevazute la art. 12 - 16, indica un risc pentru sanatate. Aceste masuri, inclusiv cerintele specificate pentru dosarele de sanatate si expuneri, precum si disponibilitatea acestora, sunt introduse īn conformitate cu prevederile legislatiei si practicii nationale.
(2) Supravegherea starii de sanatate, de ale carei rezultate se va tine seama la aplicarea masurilor de prevenire la respectivul loc de munca, se efectueaza acolo unde se īndeplinesc simultan urmatoarele conditii:
a) expunerea lucratorului la agentul chimic periculos este de asa natura īncāt se poate stabili o legatura īntre o boala identificabila sau un efect negativ al expunerii asupra sanatatii;
b) exista posibilitatea ca boala sau efectul sa apara īn conditiile specifice de la locul de munca al lucratorului;
c) tehnica de investigare prezinta un risc scazut pentru lucratori.
(3) Suplimentar fata de prevederile alin. (1) si (2), pentru supravegherea starii de sanatate trebuie aplicate tehnici adecvate de detectare a semnelor bolii sau a efectului negativ al expunerii lucratorului la agentul chimic periculos.
(4) Īn situatia īn care este stabilita o valoare limita biologica tolerabila obligatorie, astfel cum se prevede īn anexa nr. 2, supravegherea starii de sanatate este o cerinta obligatorie īn cazul desfasurarii unei activitati cu respectivul agent chimic periculos, potrivit metodelor din anexa respectiva.
(5) Lucratorii trebuie sa fie informati īn legatura cu cerinta prevazuta la alin. (4) īnainte de a li se atribui sarcina care implica riscul de expunere la agentul chimic periculos indicat.
ART. 39
(1) Īntrebuintarea carbonatului bazic de plumb - ceruza, a sulfatului de plumb si a tuturor produselor continānd acesti pigmenti este interzisa īn orice lucrare de vopsitorie, cu exceptia vopsirii vagoanelor de cale ferata, a podurilor de cale ferata, a fundului dublu al vapoarelor, a picturii decorative. Īn aceste cazuri, carbonatul bazic de plumb, sulfatul de plumb si produsele care contin acesti pigmenti vor fi utilizate sub forma de pasta sau de vopsea gata preparata.
(2) Este interzisa vopsirea prin pulverizare cu oxid (miniu) de plumb.
(3) Este interzisa munca tinerilor sub 18 ani sau a femeilor la lucrarile de vopsit care comporta utilizarea carbonatului bazic de plumb, a sulfatului de plumb sau miniului de plumb si a tuturor produselor care contin acesti pigmenti.
ART. 40
Ministerul Sanatatii Publice stabileste masurile necesare pentru a se tine permanent evidenta actualizata a fiecarui lucrator a carui stare de sanatate este supravegheata potrivit cerintelor art. 38.
ART. 41
(1) Dosarele medicale cu privire la starea de sanatate si expunere trebuie sa contina un rezumat al rezultatelor supravegherii starii de sanatate si al tuturor datelor reprezentative obtinute prin monitorizarea expunerii persoanei respective la agentul chimic periculos.
(2) Monitorizarea biologica si cerintele conexe pot face parte din supravegherea starii de sanatate.
(3) Dosarele medicale cu privire la starea de sanatate si expunere trebuie tinute īntr-o forma corespunzatoare care sa permita consultarea lor ulterioara, respectāndu-se cerinta confidentialitatii.
(4) Copii ale dosarelor medicale sunt furnizate, la cerere, autoritatilor de sanatate publica judetene si a municipiului Bucuresti.
(5) Lucratorul are acces, la cerere, la dosarele medicale de sanatate si expunere care īl privesc personal.
(6) Īn cazul īn care o īntreprindere īsi īnceteaza activitatea, dosarele medicale de sanatate si expunere sunt puse la dispozitia autoritatilor de sanatate publica judetene si a municipiului Bucuresti.
ART. 42
(1) Lucratorul este informat de medic sau de alta persoana cu calificarea necesara īn legatura cu rezultatul care īl priveste personal, furnizāndu-i-se si informatii si recomandari cu privire la orice actiune de supraveghere a starii de sanatate care trebuie sa i se aplice dupa īncetarea expunerii daca īn urma supravegherii starii de sanatate se constata ca:
a) un lucrator sufera de o boala identificabila sau de pe urma unui efect negativ asupra sanatatii, pe care un medic sau un specialist īn medicina muncii īi considera rezultatul expunerii la un agent chimic periculos la locul de munca; sau
b) a fost depasita o valoare limita biologica obligatorie.
(2) Īn cazurile prevazute la lit. a) si b) ale alin. (1), angajatorul realizeaza, simultan, urmatoarele:
a) revizuieste evaluarea riscului efectuata īn baza art. 12;
b) revizuieste masurile luate pentru eliminarea sau reducerea riscului conform art. 11 alin. (1) si art. 17 - 24;
c) tine seama de sfaturile specialistului īn medicina muncii, ale altei persoane cu calificarea necesara sau ale autoritatii de sanatate publica judetene si a municipiului Bucuresti, autoritate competenta īn aplicarea tuturor masurilor necesare pentru a elimina sau reduce riscul conform art. 19 - 24, inclusiv de posibilitatea de a repartiza lucratorul respectiv la un post de munca īn care nu exista riscul expunerii īn continuare;
d) continua supravegherea starii de sanatate si revizuirea starii de sanatate a oricarui alt lucrator care a fost expus īn acelasi mod. Īn astfel de cazuri, medicul competent sau specialistul īn medicina muncii ori autoritatea teritoriala de sanatate publica implicata poate propune ca persoanele expuse sa fie supuse unui examen medical.
ART. 43
Ministerul Muncii, Solidaritatii Sociale si Familiei si Ministerul Sanatatii Publice elaboreaza recomandari practice, cu referire la subiectele reglementate la art. 7 - 24 si la pct. 1 din anexa nr. 2, īn conformitate cu recomandarile practice elaborate de Comisia Europeana.

CAP. 4
Dispozitii finale

ART. 44
(1) Pe baza informatiilor disponibile privind agentii chimici, inclusiv a datelor stiintifice si tehnice care exista, precum si a deciziilor Consiliului Uniunii Europene, valorile limita si ghidurile necesare īn utilizare se stabilesc si, respectiv, se elaboreaza de catre o comisie formata din reprezentanti ai Ministerului Sanatatii Publice si ai Ministerului Muncii, Solidaritatii Sociale si Familiei, precum si din alti specialisti desemnati de catre acestea, dupa caz.
(2) Comisia prevazuta la alin. (1) īsi elaboreaza propriul regulament de organizare si functionare, care se aproba prin ordin comun al ministrului muncii, solidaritatii sociale si familiei si al ministrului sanatatii publice.
(3) Comisia prevazuta la alin. (1), cānd considera necesar si īn mod fundamentat, poate propune institutiilor implicate si adoptarea altor dispozitii direct conexe.
ART. 45
Ministerul Muncii, Solidaritatii Sociale si Familiei īmpreuna cu Ministerul Sanatatii Publice asigura elaborarea reglementarilor si dispozitiilor administrative necesare pentru respectarea prezentei hotarāri.
ART. 46
(1) Ministerul Muncii, Solidaritatii Sociale si Familiei transmite Comisiei Europene textele dispozitiilor de drept intern deja adoptate sau īn curs de adoptare īn domeniul reglementat de prezenta hotarāre.
(2) Ministerul Muncii, Solidaritatii Sociale si Familiei informeaza Comisia Europeana la fiecare 5 ani īn legatura cu implementarea prezentei hotarāri, indicānd punctele de vedere ale angajatorilor si ale lucratorilor.
ART. 47
Anexele nr. 1 - 3 fac parte integranta din prezenta hotarāre.

Prezenta hotarāre transpune urmatoarele directive:
a) Directiva 98/24/CE privind protectia lucratorilor īmpotriva riscurilor legate de expunerea lor la agenti chimici īn munca (a paisprezecea directiva specifica īn sensul articolului 16 paragraful 1 al Directivei 89/391/CEE), publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 131 din 5 mai 1998;
b) Directiva 91/322/CEE privind stabilirea valorilor limita cu caracter orientativ pentru aplicarea Directivei Consiliului 80/1107/CEE privind protectia lucratorilor īmpotriva riscurilor legate de expunerea la agenti chimici, fizici si biologici īn timpul lucrului, publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 177 din 5 iulie 1991;
c) Directiva 2000/39/CE de stabilire a primei liste de valori limita orientative ale expunerii profesionale īn aplicarea Directivei Consiliului 98/24/CE privind protectia sanatatii si securitatii lucratorilor īmpotriva riscurilor legate de prezenta agentilor chimici la locul de munca, publicata īn Jurnalul Oficial al Comunitatilor Europene L nr. 142 din 16 iunie 2000;
d) Directiva 2006/15/CE pentru stabilirea celei de a doua liste de valori limita orientative de expunere profesionala īn aplicarea Directivei Consiliului 98/24/CE si pentru modificarea directivelor 91/322/CEE si 2000/39/CE, publicata īn Jurnalul Oficial al Uniunii Europene (JOUE) L nr. 38 din 9 februarie 2006.
